Honda Settles Class-Action Lawsuit Honda will settle a class-action lawsuit concerning the brakes in more than 750,000 vehicles. The suit, filed in September, involves 2008-09 Honda Accords, 2009 Acura TSXs and some 2010 models. It alleges that rear brake pads are wearing out twice as fast as they should, sometimes in just 15,000-20,000 miles.

The claim cites a defective pad design that caused “excessive force to be applied to the vehicle’s rear wheels” and wore them out well before their typical 70,000-mile lifespan. Before now, Honda declined to repair the brakes under the new-car warranty or warn buyers about the frequency of brake repairs.

As part of the settlement, Honda will maintain it has done nothing wrong and that the issue poses no safety risk. The automaker has designed a new brake pad that will adjust to the braking system.

The issue arose after roughly 350 owners registered complaints with the National Highway Traffic Safety Administration.

Under the settlement, owners will be reimbursed for one-half the cost of the repair or $125, whichever is less. For owners who have not had the repair done, Honda will offer a one-time payment of $150 to have the redesigned brake pad installed.

Lawyers for the lawsuit say this is a good deal because it is difficult to prove that wear and tear on a given automotive part means it’s defective.

To state that Honda declined to repair the brakes under the new-car warranty is 100% False. My '08 Accord had it's rear brakes replaced at 21,000 miles and it was specifically noted on the warranty claim paperwork as 'Premature Wear/Failure'. This is my first Honda and outside of the rear brake problem I'm happy especially with the interior size and the cars handling.


This is nothing vs their transmissions problems.
This one was more of the pain in the b... then anything serious. I would buy Akibono pads and replace it in about 15 minutes if it was my car and they wouldn't cover by warranty. But generally, I tell you, folks. When you buy a new car, when it is about 11 months old, make a good check of all the wearable components for unusual or excessive wear. Then you will be able to get it fixed under warranty without problems. After 1 year it would be a problem and you would need a legal action such as one above.


Apparently you are in the minority, Zox, since all those other people had to sue.



Tony - I would add to that, make sure and send a letter of any problems you find so there is a record and the dealership/shop can't just flat out deny there was any problem.

My coworker complained of squeeky brakes on his 09 accord and had honda check them out a few weeks ago during an oil change. The honda dealer said they were "fine". He believes they never looked at them. A few weeks later...he now has a grinding noise. I wish I had known about this a few days ago so I could have warned him. The honda dealers have to know about this issue...class action suit!! HELLO!! Liars. I guess I will be getting the new "redesigned" brake pads since my brakes haven't given me any issues yet, but then again..I have 23k on my car and drive a lot of highway miles. Maybe I will be seeing issues soon.

I got a part #43022-TA0-A70 for the rear pads of a 2009 Honda Accord. Can anyone tell me if the part # is for the new improved pad?


My rear brakes went on my 2007 accord at 50,000 miles. I usually get around 80K on my previous accords. My main computer was also fried due to "condensation from the A/C condensor". Honda does not consider that to be a safety issue though, so they pass the repair bill on to their customer.

My son is stationed in Italy and took a brand new 2010 Honda Accord overseas with him. At 17,000 miles his brake pads are being replaced! Thanks for the info
